Terms of Service

OhKiki provides tools to plan, generate, publish, and measure marketing content across search, local, and social channels, including AI-generated content and integrations with third-party analytics and marketing services. We may add, change, or remove features from time to time.

You must provide accurate information, keep your credentials secure, and are responsible for all activity under your account. You must be at least 16 years old and able to form a binding contract. You are responsible for your team members’ use of your workspace.

You agree not to:

• use the Service unlawfully or to infringe the rights of others;
• generate or publish content that is illegal, deceptive, harmful, or violates a third party’s intellectual property;
• attempt to disrupt, reverse engineer, or gain unauthorized access to the Service;
• use the Service to send spam or to violate the terms of any connected platform (such as Google, or any social network).

You retain ownership of the data and content you provide (“Customer Data”). You grant us a limited license to host, process, and display Customer Data solely to provide the Service. You are responsible for having the necessary rights and consents to add the websites, connect the accounts (including Google Analytics and Google Search Console), and publish the content you manage through OhKiki. Our handling of personal information is described in our Privacy Policy.

The Service integrates with third-party providers (for example Google, AI model providers, SEO data providers, and publishing tools). Your use of those services is subject to their own terms, and we are not responsible for their availability or actions. Connecting a third-party account authorizes us to access it as described at the time of connection.

The Service uses artificial intelligence to generate text, images, and recommendations. AI output can be inaccurate, incomplete, or unsuitable. You are responsible for reviewing and verifying any content before you publish or rely on it. OhKiki is not liable for decisions made based on AI output.

Paid plans and credits are billed as described at the point of purchase. Unless stated otherwise, fees are non-refundable, and subscriptions renew automatically until cancelled. We may change pricing with reasonable notice; changes apply to the next billing cycle.

OhKiki, its software, and its branding are owned by Sant Limited and protected by law. Subject to these Terms, and to the extent permitted by the tools we use, you own the content you generate with the Service. We may use aggregated, anonymized data to operate and improve the Service.

The Service is provided “as is” and “as available” without warranties of any kind, whether express or implied, to the maximum extent permitted by law. We do not warrant that the Service will be uninterrupted, error-free, or that results (including rankings or traffic) will be achieved. Nothing in these Terms limits rights you may have under the New Zealand Consumer Guarantees Act 1993 or other non-excludable consumer law.

To the maximum extent permitted by law, OhKiki and Sant Limited will not be liable for any indirect, incidental, special, or consequential damages, or for lost profits, revenue, or data. Our total liability arising out of or relating to the Service is limited to the amount you paid us in the twelve months before the event giving rise to the claim.

You agree to indemnify and hold harmless Sant Limited from claims arising out of your Customer Data, your use of the Service, or your breach of these Terms.

You may stop using the Service and close your account at any time. We may suspend or terminate access if you breach these Terms or if we reasonably need to protect the Service or other users. On termination, your right to use the Service ends; sections that by their nature should survive (such as data ownership, disclaimers, and limitation of liability) will survive.

These Terms are governed by the laws of New Zealand, and the courts of New Zealand have non-exclusive jurisdiction over any dispute.

We may update these Terms from time to time. When we make material changes, we will update the “Last updated” date above and, where appropriate, notify you within the Service. Continued use after changes take effect means you accept the updated Terms.
